This website is operated by AENY Apparel e.U. (Margaretenstraße 52/22, 1040 Vienna, Austria). The terms “we, “us” and “our” used throughout this site refer to AENY Apparel e.U.

By visiting our site and/or purchasing something from us or engaging in any other way, you agree to the following terms and conditions (“Terms of Service”, “Terms”). These Terms of Service apply to all users of this website.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the website, you agree to these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access this website or use any services.

We reserve the right to update, change or replace any part of these Terms of Service at any time.

 

General

We only market and sell products to consumers. Re-selling our products without our consent is prohibited.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence or have your legal guardian's prior consent. 

We reserve the right to reject any order placed by anyone else than consumers and orders that are not consistent with our business policies and these terms or for any other reason we deem important.

You acknowledge and agree that the product images and descriptions provided on the website are for informational purposes only and may not represent all the specifications of each product. Colors displayed may be different due to different screens and/or settings.

 

Products

Some products or services may be available only online through our website. These items may have limited quantities.

We reserve the right to restrict the sales of our products or services to any person, geographic area, or jurisdiction. We also reserve the right to limit the quantities of any products or services that we offer. All product descriptions and pricings are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

We will not process orders that are incomplete, incorrect, or for products that are no longer available. If we are unable to process an order, we will inform you by email and explain the reasons. If you have already placed an order and paid for products that are no longer available, we will promptly refund the amount paid.

We do not guarantee that the quality of any products, services, information, or other materials purchased or obtained by you will meet your expectations, nor do we guarantee that any errors in the service will be corrected.

 

Payment 

Unless otherwise stated in our product descriptions, prices indicated are total prices including the VAT. Delivery costs, where appropriate, will be indicated separately through the checkout process.

Payment can be made using one of the methods mentioned our online shop. Please be advised that the payment methods offered on the Website are provided by third party payment service providers and that the use of such third party payment services are subject to such payment service providers terms of use. Please ensure that you understand and agree to all applicable terms and conditions for use of the selected payment service prior to using such third party payment services.

Discount codes or coupon codes cannot be combined.

 

Shipment 

Ordered products will be delivered to the address given by the customer in the order. 

Please keep in mind, that all delivery times on the website are estimated.

If you notice any damage to the packaging or the product, any discrepancies in the number of items, you must immediately notify us in writing at support@aeny-appael.com.

 

Right of withdrawal

Please be advised that you have a legal right to withdraw from any purchase of products (for any reason, without penalty and without having to provide an explanation, even if you are asked to within the process of return) within thirty (30) days from the delivery date of the products. 

You can exercise the right of withdrawal by emailing us to support@aeny-apparel.com or by submitting your return request through our return portal.

If you exercise your right of withdrawal, you must send the products back to us within fourteen (14) days from the date you notified us of your intention to withdraw.

Returned products must be returned with their original packaging, including all packaging materials, documents, accessories, and labels.

Please note that you will be responsible for the delivery costs of returning the products and will bear the risk during the return shipping. We do not accept responsibility for products that are damaged, stolen, or lost in transit during the return shipping. 

If you exercise your right of withdrawal, we will refund the full amount paid for the returned products within fourteen (14) days from the date we receive your return.

Unless otherwise agreed, refunds will be processed using the same payment method used for the initial transaction.

After receiving the returned products, we will check and verify that they meet the conditions specified in this section. If the verification is negative, we will notify you by email and inform you of the amount to be deducted from your refund unless you choose to have the products returned to you at your own cost.

If the returned products are so badly damaged or otherwise incomplete that they cannot be resold, we will return the purchased product to you and charge the relevant delivery costs and, if already refunded, the price of the product.

If you do not collect or accept your package for any reason when our partners attempt to deliver the products, we reserve the right to withhold twenty (20) euros to cover the return shipping and handling costs.

Links to third-party websites on this site may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of these sites, and we do not warrant and will not have any liability for any third-party materials or websites, or any other materials, products, or services from third parties. Any complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

 

User feedback, comments, reviews and other

We reserve the right to use, edit, copy, publish, distribute and/or translate comments, submissions for e.g. competitions, reviews, ideas, suggestions or other materials, on our website, social media channels, in promotional emails or offline (e.g. sales promotions).

You confirm that your comments, reviews, ideas and other submissions will not violate any right of any third-party, including trademark, copyright, privacy, personality or other personal or proprietary right. You also agree that your comments, reviews, ideas and other submissions will not contain libelous or otherwise unlawful, abusive or obscene material. Furthermore, you confirm that you write comments, reviews, ideas and other submissions only in your name and not in the name of others and that you are not pretending to be someone else.

Governing Law

Austrian law exclusively applies to contracts between us and the consumer that are governed by these Terms of Service.

The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
